Welcome to Magnetic Whimsies! By purchasing from us, you agree to the following Terms of Service. Please read carefully.
1. General Terms
These Terms of Service govern your use of my website and the purchase of custom photo magnets. By using my website and making a purchase, you accept these terms and agree to abide by them.
2. Order Placement and Acceptance
When you place an order, you are offering to purchase a product under the terms set out in these Terms of Service. I reserve the right to accept or reject any order at our discretion. An order is not considered confirmed until I send you an email confirmation with your order details.
3. Custom Orders
By placing a custom design order, you agree to provide accurate and complete images, text, or design details. You are responsible for ensuring the photos or designs you submit are of high quality, high resolution for printing and do not infringe on any third-party intellectual property rights.

Custom Design Approval: For custom design orders, I will provide you a design proof before processing. You must approve the design before we proceed with production. If we do not receive your approval within 48 hours, your order may be delayed. Custom Designs do not include each uploaded photo for the final custom photo magnet product. Instead, they are created with unique, original artwork specifically designed by me at the request of the customer or company.

High-Resolution Photos for Product Quality
To ensure the best possible quality for your custom photo magnets, I strongly recommend that all images submitted be high resolution. High-resolution images help us create a crisp, clear print and achieve the best final product.
I am not responsible for any issues arising from the use of low-resolution images. If the images you submit are of insufficient quality for printing, I will contact you to discuss possible solutions.
While I will make every effort to correct or enhance any images that are not optimal, please be aware that I cannot guarantee the same quality for images that are too low resolution. It is the customer's responsibility to ensure the images provided are suitable for printing. If I cannot improve the quality of an image, I will inform you and may request a different file to proceed with your order.
4. Pricing and Payment
All prices are listed in US currency and do not include applicable taxes (if applicable). Sales taxes will be calculated at checkout. Prices do not include shipping fees, which will be also be calculated at checkout. We accept payment via credit card, PayPal, and previously purchased gift cards with an available balance. POS payment options include cash, credit card, PayPal, Venmo, CashApp, and previously purchased gift cards with an available balance.
You are responsible for providing accurate payment information. If there is an issue with your payment or if payment is declined, we may contact you for resolution or cancel the order.
5. Order Processing Time

Standard Orders: Orders are typically processed and shipped within 2-3 business days of receipt.

Custom Orders: Custom photo magnets may take up to an additional 3-5 business days to process, depending on the complexity of the design and holiday demands. I will make every effort to ensure that images are printed with the highest quality. If there are any significant issues with an image, I will reach out to the customer to address the concern prior to processing.

Orders are processed Monday through Friday, excluding holidays.
6. Shipping and Delivery

Shipping Methods: We offer various shipping options, including standard and expedited shipping. Shipping fees are calculated at checkout.

Delivery Time: Delivery times vary based on the shipping method and location. Standard shipping typically takes 5-7 business days, while expedited shipping can take 2-3 business days.

Order Tracking: Once your order has shipped, you will receive a tracking number via email.
We are not responsible for delays caused by the shipping carrier or weather-related issues. You are responsible for ensuring the accuracy of your shipping address. If a package is returned due to an incorrect address, we will charge for re-shipping.
7. Returns and Refunds
Because our products are custom-made, we do not accept returns or exchanges. If the the product received is defective or there was an error in your order, the only options for resolution include shop credit or product replacement. Please inspect your order upon receipt.

Defective or Incorrect Products: If you receive a defective or incorrect product, please contact us within 7 days of receipt with a photo of the issue, and we will either issue a shop credit or product replacement.

Non-Defective Orders: As custom items are made to order, all sales are final after 7 days of receipt and are no longer eligible to be replaced or credited.
8. Intellectual Property
By submitting your images or designs, you retain the copyright and ownership of the content. However, you grant us a license to use the submitted content solely for the purpose of creating your custom photo magnets.
You agree not to submit content that infringes on third-party intellectual property rights or violates any laws. I reserve the right to refuse or cancel any order that contains inappropriate or illegal content.
9. Limitation of Liability
Our liability is limited to the purchase price of the product. We are not liable for any indirect, incidental, or consequential damages arising from your use of the products, including but not limited to loss of profits, business interruption, or personal injury.
10. Privacy and Data Collection
I respect your privacy. I collect only the necessary information to process your orders and communicate with you. By placing an order, you consent to the collection and use of your information in accordance with our Privacy Policy.
11. Modifications to Terms
I reserve the right to modify or update these Terms of Service at any time. Any changes will be posted on this page, and the "Last Updated" date will reflect the most recent revision.
12. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of USA and Texas. Any disputes arising from these terms shall be resolved in the courts of the USA and Texas.
